By creating an account or using myfitplan, you agree to these Terms of Service. Please read them carefully.

By accessing or using myfitplan (the "Service"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to refuse service to anyone for any reason at any time.

  • NOT nutritional counseling or dietary prescription
  • NOT personal training or exercise prescription
  • NOT a substitute for professional healthcare providers
  • NOT supervised by registered nutritionists, dietitians, or fitness professionals
  • NOT intended to diagnose, treat, cure, or prevent any disease or medical condition

What myfitplan IS:

  • An organizational tool for meal and workout planning
  • An AI-powered suggestion system based on general nutritional and fitness principles
  • Educational and informational content only
  • A tool to help you structure your personal health goals

Important: Before using our suggestions

  • Consult qualified healthcare professionals (doctors, registered dietitians, certified trainers)
  • Get medical clearance before starting any new diet or exercise program
  • Inform your healthcare provider about pre-existing conditions, allergies, injuries, or medications
  • Always follow professional medical advice over our AI-generated suggestions

User Accounts & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with others
  • Not use the Service for any illegal or unauthorized purpose
  • Not attempt to reverse engineer, decompile, or extract the source code of the Service
  • Not use the Service for commercial purposes without written permission
  • Accurately assess your own health status and limitations before implementing any suggestions

Subscription, Billing & Refunds

Subscription & Billing

myfitplan offers subscription-based access to premium features. By subscribing, you agree to:

  • Pay all fees associated with your chosen subscription plan
  • Automatic renewal of your subscription at the end of each billing period
  • Payment processing through Stripe, our third-party payment processor
  • We reserve the right to change subscription prices with 30 days advance notice
  • You will be notified of any price changes before your next billing cycle
  • Taxes may apply based on your location and will be added to your subscription price

7-Day Money-Back Guarantee

We offer a 7-day money-back guarantee for new subscribers:

  • If you are not satisfied with the Service, you may request a full refund within 7 days of your initial purchase
  • To request a refund, contact us at the email address provided in Section 18
  • Refunds are processed to your original payment method within 5-10 business days
  • After the 7-day period, no refunds will be provided for the current billing period
  • You may cancel your subscription at any time, but cancellation does not entitle you to a refund after the 7-day guarantee period
  • Upon cancellation, you will retain access to premium features until the end of your current billing period

Cancellation

You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation will take effect at the end of your current billing period.

Intellectual Property Rights

myfitplan and its original content, features, functionality, and AI models are owned by myfitplan and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Rights

  • You retain ownership of all personal data you provide to the Service
  • You grant myfitplan a limited license to process your data to provide the Service
  • AI-generated meal plans and workout suggestions are licensed to you for personal, non-commercial use
  • You may not resell, redistribute, or commercially exploit any content generated by the Service

Our Rights

  • myfitplan retains all intellectual property rights to the platform, algorithms, AI models, and branding
  • We grant you a limited, non-exclusive, non-transferable license to use the Service for personal purposes
  • This license terminates upon cancellation or termination of your account

Health & Safety

Understanding the risks

You acknowledge and agree that:

  • Implementing any diet or exercise program involves inherent health risks
  • You assume all risks associated with using the suggestions provided by myfitplan
  • myfitplan is not liable for any injuries, adverse health effects, allergic reactions, nutritional deficiencies, or other health issues that may result from following our suggestions
  • Individual results vary, and we make no guarantees about specific outcomes
  • You are responsible for consulting healthcare professionals before making any dietary or fitness changes
  • You should immediately discontinue any suggestion that causes discomfort, pain, or adverse reactions
  • Emergency situations require immediate professional medical attention, not guidance from myfitplan

Specific Warnings

  • If you have diabetes, heart disease, high blood pressure, or any chronic condition, consult your doctor before using our suggestions
  • If you are pregnant, nursing, or planning to become pregnant, consult your healthcare provider
  • If you have food allergies or intolerances, verify all ingredients and modify suggestions accordingly
  • If you have a history of eating disorders, consult a mental health professional before using meal planning tools
  • If you have injuries, physical limitations, or mobility issues, consult a physical therapist or doctor before following exercise suggestions

No Medical or Professional Relationship

Use of myfitplan does not create any professional relationship between you and myfitplan or its operators. Specifically:

  • No doctor-patient relationship is created
  • No nutritionist-client or dietitian-client relationship is created
  • No personal trainer-client relationship is created
  • No therapist-patient relationship is created
  • The Service does not diagnose, treat, cure, or prevent any disease
  • AI-generated suggestions are not personalized medical advice
  • We do not review or approve individual user data with healthcare professionals
  • In emergencies, contact your local emergency services (911, 112, etc.), not myfitplan

Regulatory Compliance

myfitplan provides educational content and organizational tools only. We do not provide professional medical, nutritional, or fitness services.

  • In many jurisdictions, nutrition counseling and exercise prescription are regulated professions
  • Our AI-generated suggestions are based on general principles and are not personalized professional services
  • Always consult licensed professionals (doctors, registered nutritionists/dietitians, certified trainers) for personalized guidance
  • You are responsible for ensuring your use of the Service complies with applicable local laws and regulations
  • If you access the Service from outside your country of residence, you are responsible for compliance with local laws

Limitation of Liability

This section limits our legal liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind
  • We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement
  • myfitplan is not liable for indirect, incidental, special, consequential, or punitive damages
  • myfitplan is not liable for personal injury, health issues, medical expenses, lost profits, or data loss
  • Our total liability for all claims shall not exceed the amount you paid in the 12 months preceding the claim, or $100 USD, whichever is less
  • Some jurisdictions limit warranty exclusions or liability limitations. In such cases, our liability is limited to the maximum extent permitted by law

Indemnification

You agree to defend, indemnify, and hold harmless myfitplan, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your use or misuse of the Service
  • Your implementation of any meal plans or workout suggestions
  • Any health issues, injuries, or adverse effects resulting from following our suggestions
  • Your violation of these Terms of Service
  • Your violation of any rights of another person or entity
  • Your violation of any applicable laws or regulations
  • Any inaccurate or misleading information you provide to the Service

myfitplan is not responsible for the practices, policies, or performance of these third-party services. Your use of third-party services is at your own risk and subject to their respective terms of service.

Modification of Terms

We reserve the right to modify these Terms of Service at any time. When we make material changes, we will:

  • Provide notice through the Service, via email, or by posting a notice on our website
  • Provide at least 30 days advance notice for material changes
  • Update the "Last Updated" date at the top of these Terms
  • Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms
  • If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription for a pro-rated refund within 30 days of the change notice

Account Termination

Your Right to Cancel

You may cancel your account at any time through your account settings or by contacting customer support. Upon cancellation:

  • Your access to premium features will continue until the end of your current billing period
  • Your account data will be retained for 30 days in case you wish to reactivate
  • After 30 days, your data will be permanently deleted unless legally required to retain it
  • You may request immediate data deletion by contacting us

Our Right to Suspend or Terminate

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activity
  • You abuse or misuse the Service
  • Your payment method fails or is declined
  • We are required to do so by law

Survival

The following sections survive termination: Intellectual Property Rights, Limitation of Liability, Indemnification, Dispute Resolution, and any other provisions that by their nature should survive.

Dispute Resolution

  • Assignment: We may assign our rights and obligations under these Terms. You may not assign your rights without our written consent
  • Force Majeure: We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control
  • Language: These Terms may be translated into other languages for convenience. In case of conflict, the English version prevails
